Terms of Service
TicTaps – real-money skill games – EU & UK
1. Parties and acceptance
These Terms of Service form a binding agreement between Tictaps B.V. (“TicTaps”, “we”, “us”) and you, the user (“you”, “player”). By creating an account or using the platform (the app, website and related services, together the “Platform”), you confirm that you have read, understood and accepted these Terms and the Privacy Policy. Do not use the Platform if you do not agree.
Certain features may be subject to additional rules of play or terms shown with that feature; in the event of conflict, the additional, specific rules prevail for that feature.
2. Definitions
- Skill contest / Tournament: a competitive format in which players use their skill to achieve a score and in which prizes are awarded on the basis of performance.
- Practice Play: play using non-redeemable virtual credits (“Tokens”) that have no monetary value.
- Cash Play: participation in tournaments with entry fees and prizes in real money.
- Player Account: the non-interest-bearing account on which your balance, entry fees and prize money are recorded.
- Permitted Location: a country/territory in which TicTaps offers Cash Play, as published on the Platform.
- Bonus Cash: promotional credit that may be used solely for entry fees and cannot be withdrawn.
3. Nature of the service – skill, not gambling
| Core provision The games and tournaments offered on the Platform are bona fide skill-based contests whose outcome is determined solely by the skill of the participants (such as speed, reaction time, memory, dexterity, spatial reasoning and judgement). The games contain no element of chance whatsoever. The outcome is not determined – not even in part – by chance; there is no random number generator or random element that influences the result. Entry fees are not bets or wagers, and prizes are not awarded on the basis of chance or on the basis of an event outside the participant’s control. TicTaps does not offer any game of chance, lottery, betting or casino, and is not a gambling operator. |

You acknowledge that winning is never guaranteed, that results depend solely on skill, and that the Platform must not be regarded as a reliable source of income.
4. Eligibility and age
To use Cash Play you must: (a) be at least 18 years old and have legal capacity; (b) be located in a Permitted Location; (c) provide accurate and complete registration information and keep it up to date; (d) use a payment method held in your own name; and (e) not have been previously excluded or banned.
The entire Platform, including Token/Practice Play, is intended solely for persons aged 18 and over. TicTaps does not target persons under 18 and does not knowingly permit their use.
TicTaps may verify your eligibility at any time (age, identity, location, payment method). If information is inaccurate or cannot be verified, TicTaps may suspend or terminate the account and, to the extent permitted by law, withhold prize money or cancel a withdrawal. Creating more than one account is prohibited and may lead to termination and forfeiture of balance to the extent permitted.
5. Permitted locations and compliance with the law
Cash Play is permitted only from Permitted Locations. The current list is published on the Platform and may change, including due to changes in law or regulation or our licensing position. Practice Play may be available more widely. You are responsible for knowing whether participation is permitted at your location; if in doubt, seek legal advice before registering.
If you provide inaccurate information about your residence or location, TicTaps may rescind or terminate the agreement and set off or withhold balance to the extent permitted by law. If your location ceases to be a Permitted Location during ongoing participation, that participation ends and your entry fee for it is refunded.
6. Account: registration, security and use
On registration you provide, among other things, a valid email address, username, password, name, date of birth and, where applicable, address, telephone number and payment/identity details. You choose a secure password and keep your login details confidential. You are responsible for all activity under your account.
An account is personal and may not be shared, sold or transferred. You must notify us immediately of any unauthorised use. To the extent permitted by law, you are liable for transactions carried out by you or by third parties with access to your device/account; this does not apply where mandatory (consumer) law provides otherwise.
You may close your account at any time via the Platform or via support@tictaps.com. On closure, any withdrawable balance is paid out via your registered payment method after the required verifications have been completed.
7. Practice Play, Cash Play and virtual currency
TicTaps distinguishes between Practice Play (Tokens) and Cash Play (real money). Tokens and other in-game items have no monetary value, are not redeemable or transferable, and may be changed, withdrawn or removed by TicTaps. You acquire no ownership or other right in them, but a limited, revocable, non-transferable licence to use them within the Platform.
8. Deposits, Player Account and currency
After verification of your Permitted Location and acceptance of these Terms, you may deposit money using a payment method held in your own name. Deposited amounts may be used solely for entry fees and applicable fees, and are recorded on your non-interest-bearing Player Account. Amounts are shown and processed in the currency applicable to your country; deposits from outside the eurozone may be converted at the then-current exchange rate.
9. Entry fees, prizes, fees and transparency
Before each entry, the entry fee, the prize available and the requirement to obtain that prize are shown to you. By entering you accept the rules of play and the – non-refundable – entry fee. TicTaps charges a fee per tournament; this fee or the published prize pool will not be reduced after your entry. The outcome is determined on the basis of the scores; in the event of a tie, the prize is shared.
10. Fair play
Results are not predetermined and TicTaps does not use bots. The outcome of each contest depends solely on the skill of the participants.
11. Withdrawals, KYC and taxes
You may withdraw withdrawable balance to your registered payment method, subject to the following:
- Withdrawal is possible only after successful KYC verification (identity, age, location and ownership of the payment method). This may require an identity document and, where applicable, a live facial capture for comparison; its processing is described in the Privacy Policy (see also Articles 6 and 22 GDPR/UK GDPR).
- A minimum withdrawal amount and possible maximum and frequency limits apply, as stated on the Platform; any fees are shown in advance and set off first.
- Withdrawals are processed within the stated period. You bear the risk of entering incorrect account/payment details.
- You are responsible for declaring and paying any taxes due on prizes.
12. Right of withdrawal (consumers)
If you are a consumer in the EU, you generally have 14 days from entering into the agreement (creating the account) to withdraw from it without giving a reason, by means of an unequivocal statement (e.g. an email to support@tictaps.com). We will then refund amounts received within 14 days.
If you expressly request that the service (Cash Play) begin within the withdrawal period and acknowledge that you lose your right of withdrawal once the service has been fully performed, the right of withdrawal lapses for the part already performed. If you are a consumer in the UK, an equivalent right of withdrawal applies under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, with the same exception for a service begun at your request and fully performed.
13. Refund policy
Entries are final. TicTaps will refund only in the event of an error by TicTaps or the Platform, where a tournament or contest does not take place, where cheating is established, or where law or regulation so requires. Requests are assessed within a reasonable period.
14. Bonuses and promotions
TicTaps may offer promotions, entirely at its discretion and on terms shown in advance. Bonus Cash may be used solely for entry fees, cannot be withdrawn, and lapses upon a withdrawal of balance. You acquire no right to the continuation of any promotion; TicTaps may change or end a promotion with due regard for rights already acquired and applicable law.
15. Anti-money laundering, sanctions and prohibited value transfer
The Platform may be used only in good faith to play in skill contests. It is prohibited to lose deliberately or to use the Platform to transfer value to another user. TicTaps may monitor account, transaction, device and location data to detect and investigate money laundering, sanctions breaches, fraud and misuse, as described in the Privacy Policy.
You represent that you do not appear on any applicable sanctions list (including those of the EU, EU Member States and the UK). On a reasonable suspicion of breach, TicTaps may suspend or terminate the account and, limited to what is necessary to (i) reverse the benefit of fraud/breach, (ii) comply with legal obligations, or (iii) compensate damage, freeze or recover balance. Any remaining lawful balance is returned to the extent permitted by law.
TicTaps operates a proportionate, risk-based policy against fraud, money laundering and sanctions breaches, appropriate to an offering of skill games. Sanctions screening is carried out against the applicable EU and UK lists. Regardless of TicTaps’ classification under anti-money-laundering regulation, banks and payment service providers may require additional checks (such as source of funds); you will cooperate with these.
16. Cheating and integrity
Cheating is prohibited. This includes, without limitation: the use of bots, AI or automation tools, VPNs or device farms; collusion or misrepresenting one’s own skill level; submitting scores through unauthorised or deceptive means; multiple accounts; and exploiting errors in a game. On breach, TicTaps may disqualify or adjust a score, suspend or terminate the account, and forfeit balance to the extent necessary and permitted by law.
17. Responsible play
TicTaps wishes to promote responsible play. Where available, you can set deposit, entry or time limits, take breaks, or exclude yourself (temporarily or permanently). Play with money you can afford to lose and do not regard the Platform as a source of income. Where there are signs of problematic play, TicTaps may take measures and refer you to support services.
18. Acceptable use
You use the Platform solely for the purpose for which it is made available and in accordance with the law. It is prohibited, among other things, to copy, reverse-engineer, disrupt or automatically query (scrape) the Platform, to circumvent security measures, to mislead or harass other users, or to infringe the rights of third parties.
19. Intellectual property, licence and feedback
All intellectual property rights in the Platform, the games, trademarks and content belong to TicTaps or its licensors. You receive a limited, revocable, non-transferable and non-exclusive licence for personal use. If you provide feedback or suggestions, TicTaps may use them freely without compensation; do not share feedback that you consider confidential.
20. User content
You are responsible for content you post. You grant TicTaps a licence to use that content to provide and improve the Platform, with due regard for the Privacy Policy and applicable law. TicTaps may remove or block content where reasonably necessary to operate or secure the Platform, enforce these Terms or comply with the law.
21. Availability, changes and maintenance
TicTaps will use reasonable efforts to keep the Platform operational, but may modify, suspend or discontinue the Platform or parts of it, temporarily or permanently, with or without notice. Interruptions due to maintenance, faults or causes beyond our control may occur. TicTaps is not liable for these, except to the extent mandatory law provides otherwise.
22. Warranties and disclaimers
The Platform is provided “as is” and “as available”. To the extent permitted by law, TicTaps excludes implied warranties and does not warrant that the Platform will be uninterrupted, error-free or free of harmful components. Nothing in this Article limits any mandatory (consumer) rights you have under applicable law.
23. Limitation of liability
To the extent permitted by law, TicTaps is not liable for indirect, consequential or incidental damage, lost profits or loss of data. TicTaps’ total liability for direct damage is limited to the amount of fees you paid to TicTaps in the twelve months preceding the event.
| Non-excludable liability Nothing in these Terms excludes or limits liability for: intent or wilful recklessness; death or personal injury caused by negligence; fraud or fraudulent misrepresentation; and any liability that cannot be excluded or limited under mandatory (consumer or data protection) law. If you are a consumer in the EU or the UK, your statutory rights remain fully in force. In particular, as against consumers in the UK, TicTaps does not exclude the obligation to perform the service with reasonable care and skill (section 49 Consumer Rights Act 2015). |

24. Indemnity
To the extent permitted by law, you indemnify TicTaps against third-party claims arising from your use or misuse of the Platform, your content, or your breach of these Terms or the law. For consumers, this applies only to damage attributable to you and with due regard for mandatory law.
25. Term, suspension and termination
This agreement applies for as long as you use the Platform. TicTaps may suspend your access or terminate the agreement, proportionately and – for consumers in the EU/UK – only with a valid reason (such as serious breach, fraud or AML grounds, or where required by law or a regulator). On termination, your right of access ends; any withdrawable lawful balance is paid out after the required verifications. Certain data may be retained after termination where necessary for legal, tax, AML, fraud-prevention, security or dispute-resolution purposes.
26. Changes to the Terms
TicTaps may amend these Terms. Material changes are announced at least 30 days before they take effect, by email or a notification in the Platform. Material changes do not apply retroactively to disputes that arose before the notification. If you do not agree, you must stop using the Platform; continued use after the effective date constitutes acceptance.
27. Governing law and disputes
These Terms are governed by the law of the Netherlands and disputes are submitted to the competent court in Amsterdam. If you are a consumer in the EU, this does not affect the mandatory protection and the jurisdiction of the courts of your Member State of habitual residence, and you may also use the European ODR platform. If you are a consumer in the UK, you retain your mandatory rights and forum under UK law, including under the Consumer Rights Act 2015; the European ODR platform does not apply to UK consumers. There is no mandatory arbitration and no waiver of collective actions.
28. Miscellaneous
TicTaps is not liable for failures due to force majeure. If a provision is void or voidable, the remaining provisions remain in force and the provision concerned is replaced by a valid provision that approximates its intent as closely as possible. You may not transfer your rights and obligations without our consent; TicTaps may do so, preserving your rights. Notices may be given electronically.
These Terms are published in English and Dutch (and in the language of each other market served). The English version is the binding version; in the event of discrepancies it prevails, without prejudice to the mandatory protection of consumers and their right to information in the language of their own market.
